Safety Concerns

Article 22

Commitment to Safety. For the purpose of this contract, “safety” means freedom from physical harm. The Employer affirms its commitment to the safety of its employees and that it will take reasonable measures to provide a safe workplace for all employees. The parties agree to the important of employees participating in maintaining a safe workplace and agree that employees shall follow all reasonable safety rules and policies, including notifying management of observed safety incidents or unsafe conditions or situations.

If an employee has a good faith belief that there is a real danger of serious physical injury to the employee and there is not enough time, due to the urgency of the hazard to get it corrected, the employee may refuse the work assignment provided the employee first asked the employee’s manager to eliminate the danger and the manager failed to do so.
